Hoping to push the Securities and Exchange Commission’s fiduciary rulemaking along, a subcommittee of the agency’s Investor Advisory Committee has drafted a proposal that would put brokers under fiduciary standards that advisors adhere to.

Under the draft proposal, the subcommittee says that a fiduciary duty for investment advice should include, “first and foremost, an enforceable, principles-based obligation to act in the best interest of the customer.”

In approaching this issue, the subcommittee says that the SEC’s goal “should be to eliminate the regulatory gap that allows broker-dealers to offer investment advice without being subject to the same fiduciary duty as other investment advisors but not to eliminate the ability of broker-dealers to offer transaction-specific advice compensated through transaction-based payments.”

The subcommittee adds that “Though it may require both regulatory flexibility to permit the existence of conflicts of interest and some regulatory changes to reduce the most severe conflicts of interest in the broker-dealer business model, the Committee believes that advisory services offered as part of a transaction-based securities business can and should be conducted in a way that is consistent with a fiduciary standard of conduct.”

    It's been a year of brand-widening initiatives for SodaStream, and not just because it cranked out its first Super Bowl ad back in February.

    In February it teamed up with Ocean Spray to co-develop cranberry juice blends exclusively for the SodaStream system. This follows deals last year with Crystal Light, Kool-Aid, and V8 for non-conventional carbonated beverages. My 2012 wish for SodaStream to strike a deal with Monster Beverage (NASDAQ: MNST  ) to make a bigger splash in the energy-drinks market hasn't materialized, but a deal with EBOOST did happen earlier this year. The initial natural energy drink flavors of orange and acai pomegranate will hit the market as SodaStream syrups during the latter half of this year, packing an all-natural energy boost and vitamins in every serving. EBOOST doesn't have the same allure as Monster or Red Bull, but the move was still a strong one since there's a real value proposition for home-crafted energy drinks. If SodaStream is successful, the big boys will be on notice. In March, SodaStream, which is based in Israel, teamed up with private-label bottler Cott (NYSE: COT  ) to produce SodaStream's existing flavors at its facility in Georgia, making it easier to get SodaStream products into the country with the world's largest soda consumption per capita.

    The next chapter in what has been a successful year will naturally write itself on Wednesday. There is plenty to prove, even after SodaStream proves quarter after quarter that it's not just a company behind a faddish novelty.

    From a technical perspective, COT jumped higher here right above its 50-day moving average of $8.14 with monster upside volume. This stock has been uptrending strong for the last month and change, with shares moving higher from its low of $7.39 to its intraday high of $8.84. During that move, shares of COT have been consistently making higher lows and higher highs, which is bullish technical price action. That move has now pushed shares of COT within range of triggering a major breakout trade. That trade will hit if COT manages to take out some near-term overhead resistance levels at $8.84 to $9 with high volume.

    Traders should now look for long-biased trades in COT as long as it's trending above its 50-day at $8.14 and then once it sustains a move or close above those breakout levels with volume that hits near or above 466,884 shares. If that breakout hits soon, then COT will set up to re-test or possibly take out its next major overhead resistance levels at $9.50 to 10.25. Any high-volume move above $10.25 will then give COT a chance to re-fill its previous gap-down zone from May that stared near $11.

    My impression is that unless they get acquired by one of the major casino operators like Las Vegas Sands (LVS) or MGM Resorts (MGM), this move into mobile gaming is a few years down the line before we see any significant results. Headlines can always goose a stock in the short term, but in the long run, it's the earnings that count, or revenue growth if you are a younger company. It must be noted that although they have a cash balance of $21.2 million and no debt, they are still losing money. This is a turnaround, speculative play, but one with significant potential.

    The real question is whether Zynga can hold off experienced casino operators if online gambling becomes a reality. Already, alliances are forming, with Boyd Gaming (NYSE: BYD  ) and MGM Resorts (NYSE: MGM  ) having linked up with bwin.party -- the same company Zynga tapped for its real-money Zynga Poker -- to help Boyd take advantage of newly legal online gambling in New Jersey. Zynga has the obvious edge with its social savvy, but established casino companies will have huge incentives to defend their turf if Zynga starts to make a serious dent in the industry.
